Risk Disclosure and Limitation of Liability
EDVI is a software service operated by EdviTrade. It connects automated trading strategies to your own exchange account through an API key that you create and control. EDVI does not hold your funds, does not give investment advice and does not guarantee any result. Please read this page before you connect a strategy.
Trading in crypto-asset derivatives is high risk
Crypto-assets are highly volatile and speculative. Perpetual futures on crypto-assets add leverage, funding payments and forced liquidation on top of that volatility. You can lose the whole trading deposit you allocate to a strategy, and in some market conditions, such as gaps, exchange outages or extreme moves, a loss can exceed the amount you expected to risk.
The European Supervisory Authorities (EBA, EIOPA and ESMA) and the EU regulation on markets in crypto-assets (MiCA) warn consumers that crypto-assets carry a high risk of losing all the money invested, that prices can change rapidly and unpredictably, and that crypto-assets are not covered by deposit guarantee or investor compensation schemes. Only trade with money you can afford to lose and that you do not need for living expenses, debts or savings goals.
EDVI is not investment advice and is not a portfolio manager
Nothing on this website, in the dashboard, in strategy descriptions, statistics, charts, blog posts, support replies or in the AI assistant is investment, financial, legal or tax advice, and nothing is a recommendation, solicitation or offer to buy or sell any crypto-asset or derivative. EDVI does not know your financial situation, experience or goals and does not assess whether automated trading is suitable or appropriate for you. Every decision to connect, configure, keep running or stop a strategy is your own, taken at your own risk and under your own responsibility.
EDVI does not take custody of your funds, cannot withdraw from your exchange account and does not manage a portfolio on your behalf in the sense of discretionary portfolio management. EDVI provides software that places orders in your account according to published strategy rules and the risk settings you choose. If the law of your country requires a licence or authorisation to use such software or to trade derivatives, it is your responsibility to check this before using the service.
Strategy statistics and past performance
All figures shown in the strategy catalogue, including profit and loss, drawdown, win rate, monthly returns and per-pair results, are statistics of the strategy's trading bots on market data at a risk multiplier of 1, net of exchange fees. They are updated daily and are not results of your account. They do not include slippage, partial fills, exchange downtime, API errors, liquidity gaps, funding rates, your actual leverage, your actual balance, your risk multipliers or the moment you joined a strategy. A machine learning filter used by some strategies was trained on data that overlaps with part of the displayed history.
Past performance, whether shown in the strategy statistics or realised by other users, is not a reliable indicator of future results. Realised results in your account will differ from the catalogue and may be negative even when the catalogue shows a profit. EDVI gives no assurance, representation or warranty as to profit, return, maximum loss, drawdown or any other performance figure.
You control the account, the API key and the settings
You open and maintain your own account with a third-party exchange (Binance, Bybit, OKX, BingX or another exchange supported in the dashboard). You create the API key, set its permissions and IP restrictions, and you can revoke it at any time in the exchange. EDVI recommends keys without withdrawal rights. You alone are responsible for keeping your exchange account, API key, secret and passphrase, EDVI login and two-factor codes confidential, and for everything done in your account with those credentials.
You choose the trading deposit (fixed amount or whole balance), the deposit asset, the trading pairs, the trading bots inside a strategy and the risk multiplier of each bot. Higher multipliers increase position size and loss proportionally. Default settings are not a recommendation. You are responsible for monitoring your account, keeping enough margin, understanding the exchange's leverage, margin and liquidation rules and for any manual actions you take in the same account while a strategy is running, which may conflict with the strategy's orders.
Third-party exchanges, software and connectivity
Orders are executed by the exchange, not by EDVI. EDVI has no control over, and accepts no responsibility for, the exchange's availability, order execution, prices, fees, funding rates, liquidation engine, position limits, rate limits, API changes, delisting of pairs, maintenance, account restrictions, insolvency or any other act or omission of an exchange or other third party. The exchange's own terms govern your relationship with it.
Automated trading depends on servers, networks, market data feeds, exchange APIs and the strategy software itself. Any of these can fail, be delayed, return wrong data or be attacked. Possible consequences include missed entries or exits, orders that are not placed or cancelled, duplicated orders, stop-loss or take-profit orders that are not placed, positions that remain open when a strategy is stopped or a pair is removed, and delayed or incorrect statistics in the dashboard. Statistics in the dashboard are informational, may be delayed or cached and are not an accounting record; your exchange account is the authoritative record. You are responsible for checking your positions on the exchange, in particular after stopping a strategy, removing a pair, changing settings or deleting a connection.
No warranties
To the fullest extent permitted by applicable law, the website, the dashboard, the strategies, the AI assistant and all related content and services are provided "as is" and "as available", without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, uninterrupted or error-free operation, or that any strategy will be profitable or will not lose money. Where a warranty cannot be excluded by law, it is limited, to the extent permitted, to the re-performance of the service or the refund of the fee paid for the affected period.
Limitation of liability
To the fullest extent permitted by applicable law, EDVI, its owners, affiliates, employees, contractors and partners shall not be liable to you for any trading losses, lost profits, lost opportunities, liquidations, exchange fees, funding payments, loss of data, loss of access to your account or any indirect, incidental, special, consequential or punitive damages arising out of or in connection with the website, the dashboard, any strategy, any statistic, any failure, delay or error of the service, of an exchange or of a third party, or your use of or inability to use the service, even if EDVI was advised of the possibility of such damages.
To the extent liability cannot be excluded, EDVI's total aggregate liability for all claims arising in any twelve-month period shall not exceed the subscription fees you actually paid to EDVI in that period.
Nothing on this page excludes or limits liability that cannot be excluded or limited under applicable law. In particular, where you act as a consumer in the European Union, these limitations do not apply to death or personal injury, to damage caused intentionally or by gross negligence, to fraud, to EDVI's liability under mandatory data protection law, or to any other liability that your national law does not allow to be excluded. Where any limitation is held to be unenforceable, it applies to the maximum extent permitted.
Your undertakings and indemnity
You confirm that you are at least 18 years old, that you are legally allowed to trade crypto-asset derivatives in your country of residence, that the funds you trade are your own and lawfully obtained, and that the API key you connect belongs to your own exchange account. You agree to use the service only in accordance with the law, the exchange's terms and these terms, and not to resell, redistribute or reverse engineer the strategies, signals or software.
To the extent permitted by law, you agree to indemnify EDVI against claims, losses and reasonable costs brought by third parties that result from your breach of these terms, your unlawful use of the service or your use of an exchange account that does not belong to you. Where you act as a consumer, this indemnity is limited to damage caused by your fault.
Service changes, suspension and termination
Strategies, trading bots, pairs, risk parameters, exchanges and features may be added, changed, paused or withdrawn at any time, including as a reaction to market conditions, exchange changes or regulatory requirements. EDVI may suspend or stop trading in your account, for example when your subscription expires, your balance falls below the minimum, your API key stops working or EDVI reasonably believes there is a security or legal problem. Stopping a strategy closes positions and cancels orders through the exchange API on a best-effort basis; it may fail or be delayed for reasons outside EDVI's control, and you remain responsible for any position that stays open.
Changes to these terms
We may update these terms. The current version is always published on this page with the date of the last update. For material changes we will notify registered users in the dashboard or by e-mail before they take effect. If you do not agree with the updated terms, stop the strategies, revoke your API key and stop using the service; continued use after the effective date means acceptance.
Applicable law and disputes
These terms are governed by the law of the EU member state in which EdviTrade, the operator of EDVI, is established, without prejudice to the mandatory consumer protection rules of the country where you reside if you are a consumer in the European Union. Consumers may bring claims before the courts of their own country of residence. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr. Before going to court, please contact us at [email protected] or through the support section of the dashboard; we aim to resolve complaints within 30 days.
